Welcome to the Holiday Rescue website, these Website Terms and Conditions (Web T&C’s) are brought to you by the team at Holiday Rescue Ltd.

Thanks for taking the time to read them. When you access this website at www.holidayrescue.com.au, you’re agreeing to the Web T&C’s here. These Web T&C’s apply to all information and services we provide on our website, and the sale of any Holiday Rescue policy. You agree that you will use this website in accordance with all applicable laws and regulations.

Reading the terms of your policy.

It is your responsibility to read and to be familiar with the policy terms and conditions. The policy T&C’s are in the PDS, which can be found throughout this website – and right here.

General information only.

We can only give general advice, which means we are not able to consider your individual needs, objectives or financial situation, therefore any information on this website is general only. The PDS is designed to help you decide if our policy is right for you and if you are still unsure after reading it, we recommend you get specialist advice.

This website communicates the good stuff.

To understand your legal rights and responsibilities, you need to read the PDS. We’ve taken care to make the information on this website as clear as possible and consistent with the PDS, however we can’t guarantee that all content is accurate and complete.

Website performance anxiety
(aka disclaimer).

We aim to provide exceptional website performance at all times. However, there may be interruptions to services or faults at times, so we do not guarantee that our website will:

  1. work or be fault-free, at all times in all locations, or that errors will be corrected
  2. be secure or private
  3. be free of viruses or other harmful items (including files displayed or delivered to you, or picked up through any website linked to it)

We go to great lengths to protect your personal information from misuse, loss, unauthorised access, modification or being leaked using best practice encryption, secure transfer and physical security, but the bad guys on the internet sometimes slip past, so we recommend that you always scan for viruses before opening any downloaded items (from anywhere).

Temporary disappearances
(of the website).

When there is an error we need to fix, or a big change we need to make to the website, we might have to take it away for a little while. This could happen suddenly without notice, if something happens we can’t control, or if there was some sort of a catastrophic failure, (we hope there never is – it would be very unlikely – but it is possible).

The good news is that whenever our website is missing, you can be sure we’ll be missing it more than you, and working 24/7 to get it back up as soon as humanly possible!

The full legalese is below, but simply put, where permitted by the law, we are not liable for anything that happens or does not happen when you use this website, or if anything on the website is missing, delayed or interrupted (including the entire website), or if there is a system failure, computer virus or technical sabotage.

The contents of this website is published by us, and is intended for use in Australia only. All dollar figures stated in this website are in Australian dollars.

Cooling-off period
– in case you change your mind.

If you haven’t left on your trip, haven’t made a claim (and don’t intend to) – and you’re within 14 days of purchasing – you can cancel and get a full refund. You need to know that if you cancel your policy, we will not pay any claims made by you. You cannot cancel your policy if you have made a claim or if the start date of your holiday has passed. Full details are in the PDS.

Glad you like it, but you can’t copy this site (or its contents).

We (and our awesome partners who helped us create this website), own all copyright and intellectual property rights of the content and functionality on this website.

When you use this website, you agree not to take or copy any part or element of this website by any method (including the use of a robot, spider, screen scraper, data aggregation tool, other device or third party) without the prior written consent of Holiday Rescue. You also agree not to reverse engineer or attempt to find source code, or recreate any formula or processes related to the software. And you agree not to use any information found through this website for any profit or gain, or reproduce, create derivative work, or display any content from this website without our prior written permission.

You also can’t frame us. That is – display all or part of our website from a frame within your site. BUT you can print, or download information from the website for your own personal use.

Be honest and play nice.

When buying an insurance product, you have what’s called a “Duty of Disclosure” which means the information you give us needs to be correct. Respectfully, we ask you to be honest with us. Everything you tell us must be complete and accurate, and you need to follow all applicable laws, regulations and codes of conduct (be respectful to others).

You should never:
(a) try to damage, impair or interfere with the website
(b) use the website to abuse, harass or defame others
(c) distribute any unlawful, obscene or defamatory material via the website
(d) get or attempt to get access to content on the website by doing anything a regular user would not know how to do, for example reverse engineering, or vandalising the website

Face your responsibilities.

You accept all responsibility for your use of this website and services, and you indemnify (guarantee) Holiday Rescue, its owners and employees against all costs, expenses and damages incurred with any claim brought against Holiday Rescue caused by your use of this website or our services, a breach of these Web T&Cs or violate another person’s rights.

Other sites are linked as a favour to you, and not guaranteed.

Where we link to other websites, they are not under our control. You are welcome to use other sites at your own risk.

We might change the rules
(these Web T&Cs).

We may update these Web T&Cs from time to time, so the Web T&Cs (as displayed here) will apply to your use of the website at the time you use it. If you visit and buy from us regularly, we’ll update the date at the top so you’ll be able to see quickly if anything may have changed since the last time you read these. Of course everything else on this website may also be updated any time, including, costs and the PDS – so please always check before you buy.

If there are ever any differences between the content of this website and the PDS, the terms and conditions within the PDS override all other content.

The “Law”.

The contents of this website and any policies issued and services provided by Holiday Rescue are governed by the laws of New South Wales, Australia. The New South Wales courts in Australia, have exclusive jurisdiction.

If any terms in these Web T&Cs are found to be illegal, invalid or unenforceable by the laws of any state within Australia, then within the state where that term is illegal, invalid or unenforceable, it will be ignored from the Web T&Cs and all other terms shall continue to be required and enforceable.

We like you, you’re the responsible type.

Thanks for reading these, we know they’re not as much fun as Harry Potter – or as life-affirming as Brené Brown’s books – but our lawyers said we have to include these and we don’t want you to get caught out by anything later!
